Criminal Defense Practice Areas in San Diego

Start with one question: is your case in state court or federal court? State cases are brought by the District Attorney or the San Diego City Attorney in San Diego Superior Court under California law. Federal cases are brought by the U.S. Attorney in the U.S. District Court under federal statutes, with different rules, a different timeline and the federal sentencing guidelines. Vikas Bajaj represents clients in both, and each area below links to a detailed guide.

Federal investigations and prosecutions, in the Southern District of California and nationwide.

White-collar and fraud

Fraud, embezzlement, money laundering and healthcare fraud allegations.

Two cases at once: the criminal charge in court and the license case at DMV.

Domestic violence

Criminal charges, criminal protective orders and the family-court restraining orders that often run alongside them.

Violent crimes

Assault, battery, weapons and homicide charges.

Drug crimes

State possession and sales charges, diversion, and federal drug cases.

Frequently Asked Questions

What is the difference between a state case and a federal case?

State cases are prosecuted by a county district attorney in Superior Court under California law. Federal cases are prosecuted by a U.S. Attorney’s Office in U.S. District Court under federal statutes. The courts, rules and sentencing frameworks differ.

Does being arrested mean I will be charged?

No. A prosecutor decides whether to file charges, ask for more investigation, or decline, and charges can change as a case develops.

Can I get in trouble for what I tell a federal agent?

Potentially, yes. Knowingly making a materially false statement in a federal matter can itself be a federal offense, so many people speak with a lawyer before agreeing to an interview.

Does a DUI arrest start more than one proceeding?

In California it can: a criminal case in court and a separate DMV action on the driver’s license, each with its own deadlines. Ask about the DMV deadline right away.

What should I do first if I am under investigation?

Do not discuss the matter with investigators, keep your documents and messages, and speak with a criminal defense lawyer before answering an interview request, subpoena or search warrant.
